TEILNAHMEBEDINGUNGEN
§ 1 Geltungsbereich
Die vorliegenden Teilnahmebedingungen gelten für die Teilnahme an dem Gewinnspiel „Startplatzverlosung Rad am Ring 2024“ und dessen Durchführung. Die Teilnahme erfolgt allein zu den hier ausgeführten Teilnahmebedingungen.
§ 2 Gewinnspiel
(1) Das Gewinnspiel wird veranstaltet von der Firma bc GmbH (im Folgenden: bc), Carlo-Schmid-Straße 12, 52146 Würselen.
(2) Die Teilnahmefrist ist zwischen dem 17.01.2024 (18:00 Uhr) und dem 31.01.2024 (23:59 Uhr) möglich. Eine verspätete Teilnahme wird nicht berücksichtigt.
(3) Es wird verlost: 1 x 2 Startplätze für eine Parzelle für das 24h Radrennen bei Rad am Ring.
§ 3 Teilnahme
(1) Teilnahmeberechtigt sind natürliche und geschäftsfähige Personen ab dem 18. Lebensjahr. Der Teilnehmer muss seinen ständigen Wohnsitz in der Europäischen Gemeinschaft haben. Mitarbeiter von bc und deren Familienangehörige sind von der Teilnahme ausgeschlossen.
(2) Teilnahmeberechtigt sind nur Verbraucher. Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können. Nicht teilnahmeberechtigt sind Unternehmer nach § 14 BGB.
(3) Die Teilnahme erfolgt über die Registrierung im Formular auf der Landingpage: https://www.bike-components.de/de/saisonstart/
(4) Der in §2 Abs. 3 definierte Gewinn wird unter allen Teilnehmern verlost.
Der Teilnehmer hat wahrheitsgemäße, genaue, aktuelle und vollständige Angaben zu seiner Person (nachstehend „Anmeldungsdaten" genannt) mitzuteilen. Die Anmeldungsdaten sind vom Teilnehmer bei Bedarf zu aktualisieren und Änderungen unverzüglich mitzuteilen.
(5) Die Anmeldungsdaten werden von bc gespeichert. Weitere Informationen zum Datenschutz in § 5 und auf https://www.bike-components.de/de/datenschutz/
(6) Bei einem Verstoß gegen die Teilnahmebedingungen oder dem begründeten Verdacht eines solchen Verstoßes durch den Teilnehmer ist bc berechtigt, den Teilnehmer mit sofortiger Wirkung auszuschließen.
§ 4 Durchführung
(1) Der Teilnehmer wird in dem Fall, dass er gewonnen hat, über den Gewinn per E-Mail kontaktiert.
(2) Der Gewinner hat sich innerhalb von 14 Tagen, nachdem er von bc informiert worden ist, bei bc zu melden.
(3) Leistungsort ist der Sitz von bc.
(4) Die Teilnehmer werden in dem Fall, dass sie nicht gewonnen haben, im Nachgang von uns per E-Mail kontaktiert.
§ 5 Anmeldungsdaten
(1) Der Teilnehmer erklärt sein Einverständnis dazu, dass sein vollständiger Name (Nachname, Vorname) im Falle des Gewinns von bc veröffentlicht wird.
(2) Der Teilnehmer erklärt sich ausdrücklich damit einverstanden, dass bc seine Anmeldungsdaten bis zur Veröffentlichung des Gewinnspielausgangs nach § 6 speichert. Die personenbezogenen Daten werden spätestens zwei Wochen nach Abwicklung des Gewinnspieles gelöscht.
§ 6 Rechteeinräumung
Der Teilnehmer erklärt sein Einverständnis, dass bc oder aber beauftragte Dritte die von ihm zur Teilnahme eingereichten Medien oder Statements u.ä. im Rahmen der Berichterstattung des Gewinnspiels nutzen. Er räumt bc das nicht exklusive Nutzungsrecht einschließlich der Berichterstattung und Öffentlichkeitsarbeit im Zusammenhang mit dem Gewinnspiel ein. Das Nutzungsrecht wird zeitlich, räumlich und inhaltlich unbeschränkt eingeräumt. Übertragung nach S. 1 gilt für alle Medien. bc ist zur umfassenden Auswertung der übermittelten Daten im Zusammenhang mit dem Gewinnspiel im Internet und allen anderen Medien berechtigt.
§ 7 Haftung
(1) Bei leicht fahrlässigen Pflichtverletzungen beschränkt sich die Haftung von bc sowie ihrer Erfüllungsgehilfen auf den vorhersehbaren vertragstypischen unmittelbaren Durchschnittsschaden. Die Haftungsbeschränkung betrifft nicht Ansprüche aus Körper- und Gesundheitsschäden oder bei Verlust des Lebens, soweit dies bc zurechenbar ist.
(2) Alle Angaben erfolgen ohne Gewähr. Dies bezieht sich insbesondere auf die Veröffentlichung der Namen der Gewinner.
§ 8 Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland. Für Verbraucher, die den Vertrag nicht zu beruflichen oder gewerblichen Zwecken abschließen, gilt diese Rechtswahl nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen wird. Die Bestimmungen des UN-Kaufrechts finden keine Anwendung.
(2) Sollten einzelne Bestimmungen des Vertrages unwirksam sein oder werden, so wird hierdurch die Gültigkeit der übrigen Bestimmungen nicht berührt.
TERMS AND CONDITIONS OF PARTICIPATION
§ 1 Scope of Application
These terms and conditions apply to participation in the competition “Starting spot Rad am Ring 2024” and its implementation. Participation takes place solely on the basis of the conditions of participation set out here.
§ 2 Raffle
(1) The competition is organised by the company bc GmbH (hereinafter referred to as “bc”), Carlo-Schmid-Strasse 12, 52146 Würselen, Germany.
(2) The participation period is possible between 17.01.2024 (6 o’clock) and 31.01.2024 (23:59 o’clock). Late participation will not be considered.
(3) There will be a raffle for: 1 x 2 starting spots for the 24h race at Rad am Ring 2024.
§ 3 Participation
(1) Eligible to participate are natural persons and persons with legal capacity who are 18 years of age or older. The participant must be a permanent resident in the European Community. Employees of bc and their family members are excluded from participation.
(2) Only consumers shall be eligible to participate. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his/her/their commercial nor to his/her/their independent professional activity. Business owners according to § 14 BGB are not entitled to participate.

(4) The prize defined in §2 para. 3 will be raffled among all participants.
The participant must provide true, accurate, current and complete personal data (hereinafter referred to as "registration data"). The registration data are to be updated by the participant if necessary and changes are to be communicated immediately.
(5) Registration data will be stored by bc. Further information on data protection in § 5 and at https://www.bike-components.de/en/data-privacy/
(6) In the event of a breach of the conditions of participation or the reasonable suspicion of such a breach by the participant, bc is entitled to exclude the participant with immediate effect.
§ 4 Implementation
(1) In the event that the participant has won, bc will notify the participant of the prize via mail.
(2) The winner must report to bc within 14 days of being informed by bc.
(3) The place of performance is the registered office of bc, i.e. Würselen.
(4) Participants who didn’t win will be contacted by e-mail afterwards.
§ 5 Registration data
(1) The participant declares his/her/their consent to his/her/their complete name (surname, first name) will be published by bc in the event of a win.
(2) The participant expressly agrees that bc may store his/her/their registration data until the outcome of the competition is published in accordance with § 6. Personal data will be deleted no later than two weeks after the competition has concluded.
§ 6 Granting of Rights
The participant agrees that bc or third parties commissioned by bc may use the media or statements etc. submitted by the participant for the purpose of reporting on the competition. They grant bc the non-exclusive right of use including reporting and public relations in connection with the competition. The right of use is granted without limitation in terms of time, space and content. Transmission according to p. 1 applies to all media. bc is entitled to comprehensive evaluation of the transmitted data in connection with the raffle on the internet and all other media.
§ 7 Liability
(1) In cases of slightly negligent breaches of duty, the liability of bc and its vicarious agents is limited to the foreseeable direct average damage typical for the contract. The limitation of liability does not apply to claims arising from bodily injury or damage to health or in the event of loss of life, insofar as this is attributable to bc.
(2) All information is provided without guarantee. This refers in particular to the publication of the names of the winners.
§ 8 Final Provisions
(1) The law of the Federal Republic of Germany shall apply. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law shall apply only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.
(2) Should individual provisions of the contract be or become invalid, this shall not affect the validity of the remaining provisions.
